There is this popular saying that all lawyers are lairs LOL.But the last time i checked, the court is no FATHER CHRISTMAS also... Abi? Why should a case be brought before the court,in which there is no proper evidence to back up the claim or suit as it is said in Legal parlance. Litigation is not a place of trial and error,
before a suit is filed in court,there should be atleast 50% of good material evidence(while further efforts are made to make it a 100%)in order to avoid loop holes, now this evidence should be both documentary and electronically generated depending on the nature of the case,proper witness(s) to testify,after they must have been properly prepared in chambers,detailed research to get acquainted with the present position of the law and every other thing to ensure the success of the case.
Now in a bad circumstance where all these things which are the basic requirements are not properly done and taken care of, please o...how can an alleged suspect be made liable or convicted. The problem most times goes to the fact that either the counsel didn't do his homework properly or the client didn't narrate all the facts of the case to his counsel during client interview at the initial stage,Should all the legal practitioners now answer LIARS because of the laziness of some...i think NO.
Courts of competent jurisdiction can only grant the prayers of the parties,the court can't go outside that except in exceptional circumstances ,Also the court works with the evidence that is brought before it.In a cases where a party on one side has done his homework properly and judgement is given in his favour to the surprise of the other party should all lawyers now be termed LIARS, o please let the good ones be given some credit, enough of the generalization.

What each lawyer in a suit seek to do is to present their case before the court in a manner which will be most favourable 2 their client. I do not believe that this is enough reason why they should be branded as liars, although there is no doubt that some lawyers are dishonest. It is now left in d hand of the court (judge) after considering d arguments and evidence of both sides to reach a just and unbiased conclusion based on the merits of the case.
ReplyDeleteIt is a noble proffession hence if u say all lawyers are liars,u need to prove it. he who asserts must prove..you come with sufficient evidence and ur given judgment in ur favour . unless your putting something on nothing and believe me u will get nothing...definitely some lawyers are not honest but no one should generalise..
